Albanian criminal proceedings against officials pass through separate stages. Each stage is a different legal act, decided by a different body. None of them before a final conviction establishes guilt.
The stages, one by one
Explanations as recorded in the research, with the source each one relies on. They are illustrated with the Balluku case, where the research describes it.
1
Immunity
Protection for a sitting MP, which in Albania requires parliament to lift it before certain criminal measures (including arrest) can be taken against the MP. Balluku is an MP, so SPAK's arrest request required a parliamentary vote.
A court measure under Article 242 of the Criminal Procedure Code that bars an official from exercising their public function while proceedings are pending. The GJKKO applied it to Balluku as minister. The Article 242(2) exclusion for persons elected under the electoral law is the point in dispute.
For a sitting MP, SPAK needed parliament to lift immunity before arrest. SPAK asked parliament for that authorisation to arrest Balluku, and parliament refused on 12 March 2026.
The prosecution's formal allegation of criminal conduct. SPAK charged Balluku over the tender allegations, reported 31 Oct 2025. A charge is an accusation, not a finding of guilt.

A final judgment of guilt after trial. None was found for Balluku or any co-defendant in the sources reviewed. Charges and measures are accusations and interim measures, not conviction.
